As you will hopefully have seen, there have been changes to the notice requirements for section 8 and section 21 notices. We blogged about these changes here https://painsmith.co.uk/amendments-to-s-8-and-s-21-notices/.
With these changes comes a new prescribed notice for each. Unfortunately, in keeping with the handling of eviction claims during the current pandemic to date, there have already been issues with these notices. The prescribed forms have already been changed twice since the first versions were released on Saturday 29th August. Both changes coming without any warning or notification once the change had been made. Given that it is a prescribed form that is required for the valid service of either notice, agents and landlords looking to rely on either of these notices need to be careful to make sure that the one they are using is the correct and up to date version.
As such and given we do not know if or when any further changes will be made, we are removing the section 21 and section 8 notices from the PainSmith document vault. Any subscribers to the PainSmith helpline who use the vault to get the notices are best advised to use the version directly from the government website at the time any new notice is required to ensure it is the correct and up to date version. You will need Form 6a for the section 21 or Form 3 for the Section 8 Notice. These can be found at the following website:
