Deposit News

1 April 2013 has seen more changes to deposit protection.

There are now four authorised schemes: TDS, DPS and mydeposits have been joined by Capita tenacy deposit protection scheme . This is an insurance based, rather than custodial scheme, meaning that the deposit is held by the agent or landlord.

It’s all change in the established schemes too. TDS have relaxed their rules and have summarised the main changes on their own blog here and in pdf form here.

    My landlord protected the deposit 4 months late and has never provided the prescribed information. The details given to DPS by the landlord are inaccurate and we have never received any details directly from them. My Landlord served a Section 21(1)(b) which we defended and the hearing has been generally adjourned for 3 months. My landlord’s solicitor sent us a cheque claiming it was return of the deposit and the Landlord has served another Section 21(1)(b) notice. The fixed term of the AST ended January 5th 2013.

    Any Ideas ?????

    A degree of common sense creeping in at last with the TDS ‘relaxation’, but where it says ‘if one of the tenants refuses consent for adjudication we cannot adjudicate’ what are the options left for a landlord/agent where the tenant does a runner. To go to small claims needs an address for the defendent and also incurs more cost for the landlord.

    My landlord has never protected my deposit and I’ve lived in the property for over a year.
    He recently tried asking us to leave due to the house being for sale. He come and said he gives us 1 month.
    Because he hasn’t protected our deposit were entitled to our deposit in full before he could section us with a notice which is 2 months end of a paying month.
